PrezzeePay Open Loop and Category eGift Card Terms and Conditions

The PrezzeePay Open Loop Card (Open Loop Card) and PrezzeePay Category Cards (Category Card) are digital gift cards offered and issued in Australia by PrezzeePay Pty Ltd (ACN 684 663 518) (PrezzeePay) and enabled for use on the UnionPay International payment network pursuant to its principal scheme membership with UnionPay International (together, ‘Cards’).
In these terms and conditions (Terms), “you” and “your” mean the person who purchases, receives or uses a Card, as applicable. “Us”, “our”, and “we” mean PrezzeePay.
Card Details are the product specific details that apply to your Card, including its currency, loaded value, Card type, permitted category or categories, geographic use, Expiry Date and any applicable purchase or issue fee. The Card Details are disclosed when the Card is purchased or issued and are available in the Prezzee App. The Card Details form part of these Terms.
If there is an inconsistency, the Card Details prevail in relation to a product specific feature of your Card and the applicable Schedule prevails in relation to a feature specific to an Open Loop Card or Category Card.
By purchasing, activating, accessing or using a Card, you agree to these Terms. If you purchase a Card for another person, you should make these Terms available to that person.
Separate Prezzee Terms of Sale and Terms of Service may apply to your purchase of a Card and your use of the Prezzee App and Prezzee Wallet. Personal information is handled in accordance with the applicable Prezzee Privacy Policy. If there is any inconsistency between these Terms and the Prezzee Terms of Service, these Terms apply to the extent of the inconsistency for matters relating to the Card.
1. Important information
1.1 The Card is a digital gift card that can be used to purchase goods and services, subject to these Terms, the Card Details and the applicable Schedule.
1.2 The Card is not a credit or debit card, not reloadable, and not a bank account. You do not earn interest on the Available Balance.
1.4 You should keep your Card details and Device secure. If someone gains access to your Card details or Device, they may be able to use the Card.
2. Definitions
In these Terms:
● Available Balance means the remaining unspent value on the Card.
● Card means a PrezzeePay Open Loop Card or a PrezzeePay Category Card issued under these Terms.
● Card Details has the meaning given at the beginning of these Terms.
● Category Card means a Card that may only be used at Merchants within the permitted merchant category or categories specified in its Card Details.
● Device means mobile phone, watch or any other device through which a Card can be accessed or used.
● Digital Wallet means a third party digital wallet supported for use with the Card from time to time, such as Apple Pay.
● Excluded Transaction means a restricted transaction under clause 8.
● Expiry Date means the date the Card expires as displayed in the Card Details or Prezzee App.
● MCC means a merchant category code used by payment networks to classify merchants.
● Merchant means a merchant that accepts the Card through the UnionPay network.
● Open Loop Card means a Card that is not restricted by MCC categories, subject to these Terms and its Card Details.
● Prezzee App means the Prezzee mobile application.
● Prezzee Wallet means the wallet functionality within the Prezzee App used to store and manage the Card.
● UnionPay means UnionPay International and the UnionPay payment network.
3. Nature of the Card
3.1 The Card is a digital Card only that is loaded with a fixed value when it is issued and can be used to purchase goods and services where UnionPay is accepted, subject to these Terms.
3.2 The Card cannot be topped up or reloaded after it is issued, except where value is credited back because of a refund, transaction reversal or correction of an error. A Card may be used more than once until its Available Balance is zero or it expires.
3.3 The Card remains the property of PrezzeePay.
4. Issuer and distributor roles
4.1 PrezzeePay is the issuer of the Card and is responsible for issuing the Card, maintaining the value represented by the Card, and processing Card transactions through UnionPay.
4.2 PrezzeePay may appoint Prezzee group companies to distribute Cards and provide access to the Card via the Prezzee App, Prezzee Wallet and customer support.
5. Activation and access
5.1 A Card is generally available for use shortly after purchase or issue.
5.2 To use your Card, you will need the Prezzee App to access and manage your Card. To make contactless payments in person, you will need to use supported contactless functionality within the Prezzee App or add the Card to a supported Digital Wallet.
5.3 Digital Wallet services are provided by third parties and may be subject to that provider’s terms. We are not responsible for the availability or performance of those third-party services except to the extent required by law. Please see the Prezzee Apple Pay Terms and Conditions here.
6. Prezzee Wallet
6.1 Prezzee provides the Prezzee Wallet within the Prezzee App.
6.2 The Prezzee Wallet allows you to access and display your Card, view available Card details, Available Balance and transaction history, manage your Card and, where supported, make contactless payments through the Prezzee App.
6.3 The Prezzee Wallet is a digital service only. It is not a bank account and does not itself hold the Available Balance.
6.4 Full terms relating to the Prezzee App and Prezzee Wallet are contained in the Prezzee Terms of Service.
7. How you can use the Card
7.1 You can use the Card to purchase goods and services from Merchants that accept UnionPay prepaid cards, subject to these Terms and any Product Schedule restrictions. Please read restrictions applicable to Category Cards in clause 9 and as set out in Product Schedule 2.
7.2 You can use the Card in accordance with clause 7.1 for online purchases, or in person at a physical Merchant. The Card number, expiry date and CVV can be used for online purchases. To use your Card at a physical Merchant, you must first add your Card to the Prezzee App and, where applicable, the relevant digital wallet provider (e.g. Apple Pay) by following the steps outlined in the how to use guides within the Prezzee App, if prompted for a PIN from the physical Merchant this is available in the Prezzee Wallet.
7.2.a To use in person, tap the Digital Wallet via Apple Pay or Prezzee Wallet at the terminal as you would a debit, credit or prepaid card.
7.2.b To use online, enter the Card number, expiry date and CVV as you would a debit, credit or prepaid card.
7.3 Each time you use the Card, you authorise us to deduct the transaction amount from the Available Balance.
7.4 You cannot spend more than the Available Balance.
7.5 If a Merchant permits split payments, you may be able to pay the difference using another payment method. Split payments are at the Merchant’s discretion.
7.6 The Card cannot be used for:
● cash withdrawals at ATMs;
● over-the-counter cash withdrawals;
● direct debit, recurring payments or instalment payment arrangements.
7.7 Some Merchants may refuse Cards or decline transactions. We are not responsible when a Merchant declines the Card or it otherwise does not proceed, except to the extent the refusal is caused by an act or omission on our part.
7.8 If the Card Details permit international use, you may use the Card at eligible overseas Merchants that accept the Card through the UnionPay network, subject to these Terms and any applicable local laws and Merchant restrictions.
7.9 If a transaction is made in a currency different from the currency of the Card, UnionPay will convert the transaction amount into the Card currency using the exchange rate it applies to the transaction. The currency conversion is settled as part of processing the transaction. The amount deducted from the Available Balance may differ from an amount displayed or estimated by the Merchant.
7.10 We do not control how a Merchant processes transactions.
8. Excluded transactions and restrictions
8.1 For security, UnionPay rules, fraud prevention, or legal reasons, the Card cannot be used for certain types of transactions (Excluded Transactions).
8.2 Excluded Transactions include transactions commonly classified (by MCC or otherwise) as:
● cash withdrawals or cash advances;
● quasi-cash transactions (including money orders or stored value top-ups);
● money transfer services;
● gambling or betting services;
● adult goods or services;
● securities or brokerage transactions;
● government or tax payments where restricted;
● cryptocurrency or digital currency transactions; and
● other transactions prohibited by local laws and regulations or relevant UPI regulations.
8.4 We may update the list of Excluded Transactions where reasonably necessary to comply with law or UnionPay rules or to address fraud, scam, security or material operational risks. Clause 25 applies to any material change affecting an existing Card.
9. Category restrictions (Category Cards only)
9.1 If your Card is a Category Card, it can only be used at Merchants whose MCC matches the permitted category or categories specified in the Card Details for that Card (and subject to the Excluded Transactions).
9.2 MCC classification is determined by UnionPay, the Merchant and the Merchant’s bank. We do not control MCC classification.
9.3 If a Merchant is incorrectly classified (or processes payments under a different MCC), your transaction may be declined.
10. Balance and transaction history
10.1 You can view your Available Balance and transaction history free of charge through the Prezzee App.
10.2 You are responsible for checking your Available Balance before making a purchase.
11. Fees and charges
11.1 Fees charged by us (if any) will be disclosed at the time of purchase or issue.
11.2 Merchants may charge their own surcharges or fees when you pay using the Card. These are set by the Merchant and are not charged by us.
12. Expiry
12.1 The Card expires on the Expiry Date displayed in Card Details and the Prezzee App.
12.2The Expiry Date will not be earlier than the minimum period required by applicable law.
12.3 You should use the Card before it expires.
12.4 If the Card expires, you may lose any remaining Available Balance unless required by law.
12.5 We do not charge post-expiry fees.
13. Refunds and reversed transactions
13.1 Refunds for goods or services purchased using the Card are subject to the Merchant’s refund policy and applicable law.
13.2 If a Merchant processes a refund, we will credit the amount received back to the Card when the refund is processed through UnionPay:
13.3 If a refund is processed back onto an expired Card, or a Card you can no longer access, you may contact Prezzee support and we will take reasonable steps to make the refunded value available to you, subject to reasonable verification, fraud and security checks and applicable law and UnionPay rules.
13.4 We may not be able to recover refunds where the Merchant has not processed the refund or has issued the refund in a form controlled solely by the Merchant.
13.5 A refund for a transaction involving currency conversion may differ from the amount originally deducted because of changes in the applicable exchange rate.
14. Disputed transactions and chargebacks
14.1 If you believe a transaction is unauthorised, incorrect, duplicated, or otherwise disputed, you should contact Prezzee support as soon as possible.
14.2 UnionPay rules may impose time limits for disputing transactions or lodging chargebacks. If you contact us outside those time limits, we may not be able to raise a dispute through the scheme.
14.3 We may request information to investigate the matter, such as transaction details and supporting documents.
14.4 We will handle disputes in accordance with applicable law and UnionPay rules
15. Lost, stolen, compromised or misused Cards
15.1 You are responsible for keeping your Card details and Device access secure, including access to the Prezzee App, Prezzee Wallet and any Digital Wallet.
15.2 If you suspect your Card has been lost, stolen or compromised, contact Prezzee support as soon as possible.
15.3 We may be able to suspend the Card to prevent further unauthorised use. However, we cannot guarantee we can stop transactions that occur before suspension takes effect.
15.4 Your responsibility for an unauthorised transaction will be determined in accordance with applicable law, UnionPay rules and the circumstances of the transaction. To the extent permitted by law, this may include consideration of whether you may be responsible for loss caused by your fraud, intentional disclosure of Card security details or failure to take reasonable steps to protect your Device, Card details or access credentials.
15.5 We will not provide a replacement Card solely because you have lost your Device, no longer have access to your Device, or your Prezzee App, Prezzee Wallet or Digital Wallet has been accessed or used by another person. You remain responsible for securing your Device and access credentials. This does not prevent us from providing a replacement Card where required by law or where we determine that a replacement is appropriate following our investigation.
16. Scam and fraud warning
16.1 Do not purchase Cards from unauthorised sellers or through private sales channels.
16.2 Do not provide Card details (including CVV and PIN) to anyone who contacts you unexpectedly.
16.3 We will never ask you to provide your full Card details to “verify” your identity.
16.4 If you believe you have been scammed, contact Prezzee support as soon as possible.
16.5 We may restrict transactions where we reasonably suspect fraud, scam activity or illegal conduct.
17. Service availability and interruptions
17.1 We aim to provide reliable access to the Card through the Prezzee App, but uninterrupted access cannot be guaranteed. Temporary interruptions may occur due to maintenance, outages, third party failures, UnionPay issues, or Device Wallet outages. We will take reasonable steps to restore services for which we are responsible as soon as practicable.
18. Transactions without presenting the Card
18.1 If you use the Card online or via a digital wallet, it has the same legal effect as if you presented the Card. You are responsible for selecting the correct Card in your Device wallet.
19. Our right to restrict or suspend the Card
19.1 We may suspend, restrict, cancel the Card or decline a transaction if we reasonably believe it is necessary to:
● comply with law, regulator requirements or UnionPay rules;
● prevent or investigate fraud or scam activity;
● address a security or technical issue; or
● respond to a material breach of these Terms.
19.2 Where reasonably practicable and lawful, we will notify you of a restriction, suspension or cancellation and provide a way to contact us.
19.3 If we cancel the Card where you have not breached these Terms and there is no fraud or unlawful conduct, we will take reasonable steps to allow you to access the remaining Available Balance unless prohibited by law.
20. No cash redemption
The Card cannot be redeemed for cash or transferred to a bank account, except where required by law.
21. Consumer Law rights
21.1 Nothing in these Terms excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under applicable Australian law.
22. Liability
22.1 We are not responsible for goods or services purchased using the Card. Issues with goods or services must be resolved with the Merchant.
22.2 To the extent permitted by law, we are not liable for loss to the extent it is caused by an act or omission of a Merchant, your Device or a Digital Wallet or a failure of UnionPay outside our reasonable control, or your failure to comply with these Terms. Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
23. Privacy and information handling
23.1 Personal information is handled in accordance with the Prezzee Privacy Policy.
23.2 We may collect and use information (including mobile number and Device information) to provide the Card, prevent fraud, process transactions, handle disputes, and comply with legal and UnionPay obligations.
23.3 We may disclose information to third parties where necessary to operate the Card, including service providers, UnionPay, fraud monitoring providers, and regulators or law enforcement where required by law.
24. Complaints (including AFCA)
24.1 If you have a complaint about a Card, contact Prezzee support via the Prezzee website.
24.2 We will consider your complaint in accordance with applicable law and our complaints process.
24.3 AFCA escalation: PrezzeePay is a member of the Australian Financial Complaints Authority (AFCA). If you are not satisfied with our response, you may be able to lodge a complaint with AFCA. AFCA provides free and independent dispute resolution services.
25. Changes to these Terms
25.1 We may update these Terms from time to time.
25.2 We may make changes immediately if required to comply with law or UnionPay rules or to address security or fraud risks. A change will not reduce the Available Balance or shorten an existing Card's Expiry Date below the period required by law.
25.3 If a change materially disadvantages you in relation to an existing Card, we will give you reasonable notice and, where reasonably practicable, at least 30 days notice, unless an immediate change is required by law, UnionPay rules or a material security or fraud risk.

26. Recipients
26.1 If you acquire a Card for another person, you should make these Terms available to that person before they use the Card.
27. Communication
We may communicate with you about the Card by email, SMS, phone, or in-app notifications using the contact details you provide.
28. Severability
If any part of these Terms is invalid or unenforceable, that part is severed and the remainder continues.
29. Governing law
These Terms are governed by the laws of New South Wales, Australia and you submit to the non-exclusive jurisdiction of NSW courts.
SCHEDULE 1 — PREZZEEPAY OPEN LOOP EGIFT CARD
1. Where you can use the Open Loop Card
1.1 The Open Loop Card can be used at Merchants that accept the Card through the UnionPay network , subject to these Terms and the Card Details.
1.2 The Open Loop Card is not restricted to a specified merchant category but remains subject to Excluded Transactions and any geographic restriction specified in the Card Details.1.3 If the Card Details permit international use, clauses 7.8 and 7.9 apply.
2. Card value
2.1 The value that may be loaded onto an Open Loop Card is subject to the minimum and maximum limits applying to the relevant sales channel at the time of purchase or issue.
2.2 The Open Loop Card is not reloadable.
2.3 The Open Loop Card may be issued with whole-dollar or cents denominations depending on the sales channel.
3. Fees
3.1 Any purchase or issue fee is governed by clause 11 and will be disclosed before purchase.
3.2 The card fee is payable at purchase and is non-refundable except where required by law.
4. Expiry
The Expiry Date is shown in the Card Details and Prezzee App and is subject to clause 12.
SCHEDULE 2 — PREZZEEPAY CATEGORY GIFT CARD
This Schedule applies to PrezzeePay Category eGift Cards (for example, the PrezzeePay Fuel Gift Card or Supermarkets Gift Card).
1. Where you can use the Category Card
1.1 The Category Card can only be used at eligible Merchants that accept the Card through the UnionPay network and whose MCC matches the permitted category or categories specified in the Card Details.
1.2 The Category Card may only be used within the geographical area specified in the Card Details.
1.3 An online or marketplace transaction may be declined if the Merchant processes the transaction under an MCC or geographic location that falls outside the Card's permitted use.
2. Permitted MCC categories
2.1 The permitted MCC category or categories for your Category Card will be displayed in the Card Details or Prezzee App or Prezzee Website and/or at the time of purchase or issue.
