These Prezzee Apple Pay Terms and Conditions (Apple Pay Terms) apply if you register and/or use your Eligible Gift Card with Apple Pay.

If you are unsure whether your gift card is an Eligible Gift Card, you can find out by visiting the Prezzee Website or Prezzee App.

By registering and using your card with Apple Pay, you agree to be bound by these Apple Pay Terms. When adding your card to your Apple Wallet, you may be requested to 'Agree' or 'Disagree' to these Apple Pay Terms. If you select 'Disagree', you may not register or use your Eligible Gift Card with Apple Pay.

These Apple Pay Terms should be read together with the PrezzeePay eGift Card Terms, the Prezzee eGift Card Terms, and any applicable Retailer terms, which also apply to and govern your use of your Eligible Gift Card with Apple Pay. In the event of any inconsistency between any of the above terms, these Apple Pay Terms shall take precedence.

1. Adding and Using your Card with Apple Pay

You can add your Eligible Gift Card to your Apple Wallet on a Supported Device by clicking the "Add to Apple Wallet" button in the Prezzee App or otherwise directly via the Apple Wallet by inputting your Eligible Gift Card details.

Once you have successfully added your Eligible Gift Card to your Apple Wallet, you may use Apple Pay to process payments with your Eligible Gift Card at contactless payment terminals using your Supported Device or through online or in-app checkouts anywhere Apple Pay is supported.

You can remove your Eligible Gift Card from Apple Pay at any time by following the instructions available on the Apple support website or through Apple Wallet.

2. Access and Security

You are responsible for taking steps to keep your Eligible Gift Card and the Supported Device on which it has been registered with Apple Pay secure. This includes ensuring that you do the following:

(a) do not share use or access of your Supported Device with any other person and do not register your Eligible Gift Card on anyone else's device;

(b) keep your passcode secret, do not share your passcode with any other person, do not keep a record of your passcode together with or close to your Supported Device and do not choose a passcode that may be easily guessed (like your date of birth, part of your name or simple combinations like '1111' or '1234');

(c) only register biometric identifiers (e.g. fingerprints or face print) that allow access to your Supported Device and make Apple Pay payments that belong to you, and if applicable immediately remove all other biometric identifiers not belonging to you from your Supported Device;

(d) lock your Supported Device when not in use or when unattended;

(e) remove your Eligible Gift Card from Apple Pay and factory reset your Supported Device before transferring ownership or possession of your Supported Device to another person or before disposing of your Supported Device;

(f) limit the number of Supported Devices you have your Eligible Gift Card registered with;

(g) keep the operating system and anti-virus software for your Supported Device up-to-date; and

(h) always apply and act with due care with respect to the general security of your Eligible Gift Card and Supported Device.

If you fail to take any of the steps in this Section 2, and someone else can access your Apple Pay to make transactions using your Eligible Gift Card, those transactions will be considered as having been made by you and we will not be liable for any loss you suffer for those transactions.

In the event your Supported Device is lost or stolen or has its mobile service disconnected without your knowledge or permission, or you suspect or become aware that someone else has accessed your Apple Wallet or has made a transaction using Apple Pay without your permission, you should immediately remove your Eligible Gift Card from Apple Pay and you may contact us for assistance with securing your Eligible Gift Card.

3. Fees and Charges

We don't require you to pay any additional fees or charges if you register and/or use your Eligible Gift Card with Apple Pay.

You may however incur third party fees or charges in connection with downloading Apple Wallet and using Apple Pay on your Supported Device (such as internet or cellular charges or additional fees imposed by a merchant at checkout). You are responsible for paying all such third-party fees and charges.

4. Apple Pay is provided by Apple

Apple Pay is a technology service that is provided by Apple and not us.

We are not responsible for any loss or inconvenience you suffer in connection with:

(a) the operation, functionality or provision of Apple Pay, including any error in or reduced performance or unavailability of the Apple Pay service (whether caused by a third-party software or network provider or otherwise);

(b) any failure, inability or refusal of merchants to process transactions using Apple Pay; or

(c) your use of Apple Pay in a way that is not permitted by Apple.

Apple provides its own Apple Pay terms and conditions that govern your relationship with Apple when downloading and registering to use the service on your Supported Device. You will also need to accept such terms and conditions to register and use your Eligible Gift Card with Apple Pay.

Apple, the Apple logo, Apple Wallet, Apple Pay, iPad, iPhone, Apple Watch and Mac are trademarks of Apple Inc.

5. Privacy

We collect, use and disclose information relating to your use and management of your Eligible Gift Card with Apple Pay in accordance with our Privacy Policy available at https://prezzee.com.au/en-au/policies/privacy-policy and any privacy notice or collection statement you have previously been notified of and have accepted relating to your Eligible Gift Card.

This information may include your Eligible Gift Card's transaction history, contact information, Eligible Gift Card details (such as card number, expiry date, security code and PIN) and information about your Supported Device (such as app version, device type, operating system and security settings).

We may exchange your information with Apple, our card scheme providers (including UnionPay for certain PrezzeePay Eligible Gift Cards) and the Retailer(s) applicable to your Eligible Gift Card to:

(a) facilitate the use and management of your Eligible Gift Card with Apple Pay;

(b) ensure security of the use and management of your Eligible Gift Card with Apple Pay, including to detect and prevent fraud and/or verify your identity;

(c) provide you with customer support, handle disputes and generally improve Apple Pay and the associated services provided to you; and

(d) comply with applicable laws or respond to regulatory or governmental requests.

By registering your Eligible Gift Card with Apple Pay, you consent to our collection, use and disclosure of your information as set out in this section. If you don't want us to collect, use or disclose your information in this way, you should not register your Eligible Gift Card with Apple Pay.

6. Our Rights

We may terminate, suspend or refuse your registration and/or use of your Eligible Gift Card with Apple Pay at any time without notice if:

(a) your Eligible Gift Card expires, terminates, is withdrawn or is blocked in accordance with the PrezzeePay eGift Card Terms, the Prezzee eGift Card Terms or any applicable Retailer terms;

(b) you have breached any of these Apple Pay Terms, the PrezzeePay eGift Card Terms, the Prezzee eGift Card Terms, or any applicable Retailer terms;

(c) we deem it reasonably necessary to prevent any loss to you, us or any other person, including if we suspect fraudulent or unauthorised transactions are likely to occur or have occurred;

(d) required by applicable laws (including those relating to sanctions or anti-money laundering and counter-terrorism financing) or any regulatory or governmental body;

(e) Apple or the relevant card scheme provider tells us to or if Apple suspends or terminates the Apple Pay service, or its agreement with us in respect of Apple Pay;

(f) you use Apple Pay or your Supported Device in a manner not permitted by Apple; or

(g) we reasonably and fairly require it for any reason to protect our legitimate business interests or address any material risk.

7. Changes to these Apple Pay Terms

We can make changes to these Apple Pay Terms at any time acting reasonably and fairly.

The reason for these changes may include any one or more of the following:

(a) to comply with any change in applicable law or regulations;

(b) for security purposes or to address any other risk to you, us or any other person;

(c) to reflect changes in our products, platform, operations, systems or processes, the way that we do business, and/or any costs incurred by us in facilitating your use of your Eligible Gift Card with Apple Pay;

(d) to comply with any requirement by Apple or a relevant card scheme provider, including which may be due to a change to the functionality or operation of Apple Pay or the terms under which it is provided by Apple; or

(e) to clarify or simplify these Apple Pay Terms or include new features where relevant.

We will notify you of any changes to these Apple Pay Terms in the same way we notify you of any changes made to the Prezzee eGift Card Terms. In any case, you should regularly check for updates to these Apple Pay Terms by visiting where they are published on the Prezzee Website or Prezzee App. Whether changes have been made to the last version will be indicated by the version effective date at the top of these Apple Pay Terms. You agree to receive notifications in this way and your continued registration and use of your Eligible Gift Card with Apple Pay will indicate your acceptance of the updated Apple Pay Terms. If you do not agree to the changes made, you must cease use of your Eligible Gift Card with Apple Pay and remove your Eligible Gift Card from your Apple Wallet.

8. Severability

Should any provision or part of these Apple Pay Terms be deemed unlawful, void or for any reason unenforceable, then that provision or part shall be deemed severable from these Apple Pay Terms and shall not affect the validity and enforceability of any remaining provisions.

9. Governing Law

These Apple Pay Terms are governed by the laws of New South Wales, Australia, and both we and you agree to submit to the exclusive jurisdiction of the courts located there.

10. Meaning of words

Apple means Apple Pty Limited (ABN 46 002 510 054) and/or its related bodies corporate.

Apple Wallet means the application provided by Apple on Supported Devices which acts as a digital storage container for your Eligible Gift Card.

Apple Pay means Apple Wallet and the service provided by Apple which allows contactless payments to be made using cards that have been stored to the Apple Wallet.

Eligible Gift Card means the digital gift card sold by us that we determine is compatible for use with Apple Pay.

Prezzee App means the mobile application provided by us that allows you to buy, store and send the digital gift cards sold by us.

Prezzee eGift Card Terms means the Prezzee eGift Card Terms of Sale and Prezzee eGift Card Terms of Service available on the Prezzee Website or through the Prezzee App.

PrezzeePay eGift Card Terms means the terms specifically relating to your PrezzeePay branded Eligible Gift Card provided to you, and that you are required to accept, when purchasing your PrezzeePay Eligible Gift Card. These terms are available on the relevant product page for your Eligible Gift Card on the Prezzee Website or through the Prezzee App.

Prezzee Website means https://www.prezzee.com.au or such other website we tell you.

Retailer means the issuer of a closed loop Eligible Gift Card and/or their participating partner retailers whose products and services may be purchased through use of the Eligible Gift Card.

Supported Device means an Apple device such as an iPhone, iPad, Mac, Apple Watch or other supported device which uses the Apple operating system and supports Apple Pay, which we determine may be used for registration of your Eligible Gift Card with Apple Pay. If any unauthorised modifications are made to your device, including by removing any software or hardware controls (known as 'jailbreaking'), the device will not be a Supported Device.

UnionPay means UnionPay International Co. Ltd and/or its related bodies corporate.

we or us or our or Prezzee means Prezzee Pty Limited ABN 16 602 963 422 and/or its related bodies corporate, including PrezzeePay Pty Ltd, as applicable.

you or your means person who registers the Eligible Gift Card that is used with Apple Pay.
